Условия для организаторов

Этот документ опубликован на английском языке.

Version 1.0 — effective 18 September 2026

These Terms are a contract between you (the organiser) and FINDYOURDREAMSPACE LTD, a company registered in England and Wales (company number 17024024, registered office 167-169 Great Portland Street, London, England, W1W 5PF) ("FYDS", "we", "us"). They apply when you create an organiser profile, publish listings, or receive bookings through findyourdream.space (the "Platform"). By creating an organiser account, you agree to these Terms.

These Terms work together with our Cancellation & Refund Policy, Content & Reviews Policy and Privacy Policy, which form part of your agreement with us.

1. What FYDS is — and what it is not

1.1. FYDS is an online marketplace. We provide the tools through which you present, promote and sell your own experiences: curated listings, discovery, booking facilitation, communication tools, reviews and — where enabled — payment collection on your behalf.

1.2. FYDS is not the organiser, provider or seller of any experience. We do not design, package or combine travel services. We are not your employer, partner or joint venturer. You act as an independent business at all times.

1.3. Every contract for an experience is between you and the participant. We are never a party to it. You are solely responsible for delivering every part of your experience, including any accommodation, meals, transport or other services it includes.

1.4. Nothing on the Platform — including our curation of listings — is a verification, endorsement or guarantee of you or your experience by FYDS. Curation is editorial selection only.

2. Your account and eligibility

2.1. You must be at least 18 and have the legal right to run your business and sell your experiences in every location where you operate.

2.2. You must provide accurate information at registration and keep it up to date, including your legal name (or company name and number), contact details, and the country where your business is established.

2.3. Your account is personal to your business. You are responsible for everyone who uses it and for keeping your login credentials secure.

3. Onboarding and declarations

3.1. Before your first listing is published, you must complete our onboarding declarations, confirming:

  • that you hold all licences, permits, registrations and qualifications required for your experiences and locations;
  • that you hold the insurance described in section 12;
  • whether any of your experiences is a "package" under package travel law (see section 10), and that you meet the obligations that status carries;
  • that your listings will be accurate and lawful.

3.2. We rely on your declarations. We do not audit, verify or certify them, and we may ask you to provide supporting documents (such as insurance certificates) at any time.

3.3. We decide, at our discretion, which organisers and listings appear on the Platform. Curation decisions are editorial. Where we decline or remove a listing, we will tell you why.

4. Listings

4.1. You create, price and describe your experiences yourself. Every listing must include the information our listing template asks for, including:

  • your identity as the seller;
  • the total price and what it includes and excludes;
  • dates, duration and location;
  • who the experience is suitable for, including any fitness, skill or age requirements;
  • the minimum number of participants (if any) and what happens if it is not reached;
  • the cancellation tier that applies (see section 9).

4.2. Your listings must be accurate, must not be misleading, and must comply with consumer law in the countries where you sell. You are the trader for consumer law purposes, and the legal duties owed to consumers as seller are yours.

4.3. Prices shown to participants must be the total price. Do not add compulsory charges at a later stage.

4.4. You must keep availability up to date and honour the prices and terms shown at the time a participant books.

5. Bookings

5.1. A participant's booking request is an offer to you. A binding contract between you and the participant forms when you confirm the booking through the Platform.

5.2. You must confirm or decline booking requests promptly, and always within 24 hours. Where the experience starts within 3 days of the request, you must respond within 6 hours, or the request may lapse and the participant will be told you are unavailable.

5.3. You must confirm every booking through the Platform, even where the participant pays you directly. This keeps records accurate, enables verified reviews, and is a condition of using the Platform.

5.4. Once you confirm a booking, you must deliver the experience as described. If you cannot, section 9 (cancellations) applies.

6. Payments — current phase

6.1. This section applies while payment through the Platform is not enabled for your account.

6.2. You invoice and collect payment from participants directly. FYDS never receives, holds or transmits participants' money in this phase, and has no responsibility for payment or refund transactions between you and participants.

6.3. You must state your payment terms clearly to participants before they commit, and issue refunds you owe under your cancellation tier promptly, from your own funds.

7. Payments — when Platform payments are enabled

7.1. This section applies once payment through the Platform is enabled for your account. Payments are processed by Stripe through Stripe Connect. You must create and maintain a Stripe connected account and accept Stripe's own terms, including the Stripe Connected Account Agreement.

7.2. Payment agent appointment. You appoint FYDS as your limited agent solely for collecting payments from participants on your behalf. Payment by a participant to FYDS (through Stripe) discharges the participant's payment obligation to you, whether or not you subsequently receive the funds. FYDS holds no participant funds: amounts are routed to your Stripe connected account under Stripe's rules.

7.3. Booking fee. We deduct a booking fee of 10% of the total booking value (including VAT where applicable) from each transaction before payout. The fee is earned when you confirm the booking.

7.4. Refunds. Where a refund is due under the Cancellation & Refund Policy, you authorise us to instruct Stripe to reverse or debit the relevant amount from your connected account.

7.5. Our fee follows the refund. Where a participant receives a refund, we return the share of our booking fee that corresponds to the refunded amount. Where you retain payment under the applicable cancellation tier, we retain our fee on the amount you keep.

7.6. Chargebacks. Chargebacks, payment disputes and associated processor costs relating to your bookings are your responsibility and may be deducted from your payouts. We will pass on relevant booking evidence to support you in disputes.

7.7. Currency. You price in the settlement currency of your Stripe account. Any converted prices shown to participants are indicative.

7.8. Taxes. You are responsible for all taxes on your sales, including determining, charging and remitting VAT or equivalent taxes on your experiences. Our booking fee is charged for our platform service to you; you are responsible for any reverse-charge accounting that applies to it in your country.

7.9. We may change the booking fee or introduce new fees by giving you at least 30 days' notice. Changes apply to bookings confirmed after the notice period ends.

7.10. Reserve. We may hold back a percentage of your payout (a "reserve"), or apply a rolling reserve, where we reasonably believe this is needed to cover potential refunds, chargebacks or disputes — for example for new organisers, higher-risk activity categories, or accounts with an elevated dispute rate. We will tell you the amount and when it will be released.

8. Keeping transactions on the Platform

8.1. Once a participant has contacted you or booked with you through the Platform, you must not, for 12 months, encourage or accept payment off-Platform for that participant's bookings in order to avoid our booking fee. (This applies only once Platform payments are enabled.)

8.2. You may of course serve your existing clients and market your business anywhere. This section covers only demand that FYDS generated.

9. Cancellations and refunds

9.1. Each listing must adopt one of our standard cancellation tiers (Flexible / Moderate / Strict), as defined in the Cancellation & Refund Policy. The tier shown on the listing at the time of booking is binding on you for that booking.

9.2. If you cancel a confirmed booking, the participant is entitled to a full refund, regardless of tier. Repeated cancellations may lead to removal from the Platform.

9.3. If your experience depends on a minimum number of participants, and that minimum is not reached, you may cancel by the deadline stated in your listing; the participant receives a full refund or, if they agree, a transfer to another date.

9.4. Where a legal right of cancellation applies to a participant (for example, the 14-day cancellation right for services without a fixed date), you must honour it. The Cancellation & Refund Policy explains when this applies.

10. Package travel

10.1. Some experiences — typically those combining accommodation with activities, transport or other tourist services — are "packages" under the Package Travel and Linked Travel Arrangements Regulations 2018 or equivalent laws elsewhere.

10.2. Where your experience is a package, you are its organiser under those laws. You are responsible for every obligation that status carries, including performance of the whole package, required pre-contract information, and insolvency protection for participant payments where the law requires it.

10.3. FYDS does not combine travel services, does not sell packages, and is not the organiser or retailer of your experience. You must not describe FYDS to participants or authorities as the organiser or seller of your experience.

10.4. If you are unsure whether your experience is a package, take advice before listing it. Confirming your package travel status truthfully at onboarding is a condition of listing.

11. Safety

11.1. You are solely responsible for the safety of your experience: risk assessment, instructor and staff qualifications, venue and equipment safety, first aid arrangements, emergency procedures, and compliance with health and safety law where the experience takes place.

11.2. You must tell participants before booking about any fitness, skill, age or health requirements, and give them a direct way to disclose health or dietary information to you. Collect health and dietary information through your own channels — never through Platform messaging.

11.3. You are the emergency contact for your experiences. FYDS support is not an emergency service.

12. Insurance

12.1. You must hold and maintain public liability insurance appropriate to your activities and locations, with a minimum cover of £1,000,000 per claim (or the local equivalent), plus any insurance required by law for your activity (for example, professional indemnity for coaching, or specific cover for higher-risk activities).

12.2. You must provide certificates of insurance within 7 days of our request. We may suspend listings if you cannot.

12.3. FYDS does not insure you, your experiences or your participants.

13. Your content and intellectual property

13.1. You keep ownership of the content you upload — descriptions, photos, videos and your brand ("Your Content").

13.2. You grant FYDS a non-exclusive, worldwide, royalty-free licence to use, host, display, reproduce, adapt (for example, crop or translate) and promote Your Content for operating and marketing the Platform, including in FYDS marketing channels. The licence ends when your listing is removed, except for content already embedded in reviews, bookings records, or marketing materials created while it was live.

13.3. You warrant that you own or have permission to use everything in Your Content, including photographs of identifiable people, and that Your Content does not infringe anyone's rights.

13.4. The Platform, the FYDS brand and everything we create remain ours. These Terms give you no rights in them beyond using the Platform.

14. Reviews

14.1. Participants with confirmed bookings may review your experiences after they take place. Reviews are governed by the Content & Reviews Policy.

14.2. You must not: write or commission reviews of your own experiences; offer incentives for reviews; ask participants to change or remove reviews as a condition of anything; or attempt to prevent participants from reviewing.

14.3. You may respond publicly to any review of your experience.

14.4. We remove reviews only where they breach the Content & Reviews Policy — never simply because they are negative.

15. Data protection

15.1. When we share participant data with you for a booking or enquiry, you receive it as an independent controller. You must:

  • use it only to communicate about and deliver the relevant experience;
  • not add participants to marketing lists without their own valid consent given to you;
  • protect it with appropriate security, and delete it when no longer needed;
  • comply with UK GDPR, EU GDPR, or other applicable data protection law;
  • tell us without undue delay at security@findyourdream.space if you suffer a personal data breach involving data received through the Platform.

15.2. Our handling of personal data is described in the Privacy Policy.

16. Platform rules, suspension and removal

16.1. We may suspend or remove listings, restrict features, or terminate your account if you breach these Terms or the policies they incorporate, if your declarations prove untrue, if we receive serious credible complaints, or if the law requires it.

16.2. Except where the issue is urgent (safety, fraud, legal risk), we will give you notice and a chance to fix the problem first. When we suspend or terminate, we will give you our reasons in writing.

16.3. You can close your account at any time. Confirmed bookings must still be honoured or cancelled under section 9, and sections that by their nature continue (including 13.2, 15, 17, 18 and 21) survive.

16.4. Fraudulent or manipulated transactions. You must not book your own experiences, use associated accounts to create fictitious bookings, or otherwise manipulate bookings, reviews or payouts. This is a serious breach under 16.1 and may result in immediate suspension, withheld payouts, and referral to Stripe, our payment processor, and/or the police where fraud is suspected.

17. Indemnity

17.1. You will compensate FYDS for losses, claims and reasonable costs we incur because of:

  • claims by participants or third parties arising from your experiences or your failure to deliver them;
  • Your Content infringing someone's rights;
  • your breach of these Terms, your declarations, or the law applicable to your business.

17.2. This does not apply to the extent a loss is caused by FYDS's own negligence or breach. We will tell you promptly about any claim and will not settle it without consulting you.

18. Liability

18.1. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

18.2. Subject to that, FYDS is not liable to you for: loss of profits, revenue, goodwill or data; the acts or omissions of participants; or events outside our reasonable control.

18.3. We provide the Platform with reasonable care and skill, but we do not promise uninterrupted availability, or any particular volume of enquiries, bookings or revenue.

18.4. Subject to 18.1, our total liability to you in any 12-month period is limited to the fees you paid us in that period or, if greater, £100.

19. Changes to these Terms

19.1. We may update these Terms and the incorporated policies. We will give you at least 15 days' notice of changes by email, or longer where a change significantly affects you. If you do not accept a change, you may close your account before it takes effect; continuing to use the Platform after that date means you accept it.

19.2. We may make changes immediately only where required by law or urgent security need.

20. Complaints

20.1. If you have a complaint about the Platform or a decision we have made, contact complaints@findyourdream.space. We will acknowledge your complaint within 5 working days and give you a full response within 15 working days. Our complaints process is free.

21. General

21.1. These Terms, the policies they incorporate, and your onboarding declarations are the entire agreement between you and FYDS about the Platform.

21.2. You may not transfer your agreement with us without our consent. We may transfer ours as part of a sale or reorganisation of our business, with notice to you.

21.3. If part of these Terms is found unenforceable, the rest continues to apply.

21.4. These Terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over disputes between you and FYDS.
